利用規約

本利用規約（以下、「本規約」といいます）は、わたしたち「ミルグラム管理委員会」が権利者として管理する「ミルグラム」（音楽やキャラクター等を含み、以下、「本コンテンツ」といいます）について、みなさまが、それらを使って二次創作活動などを行う事に対し、「利用可能事項」と「利用禁止事項」等の説明/解説を明記したものとなります。

【本規約締結の目的】
本コンテンツは、わたしたちの許諾無しに、使用、利用、公表する行為等は、日本国の法令により禁止されていますが、わたしたちは、みなさまの使用、利用、公表に対し、限定された法的使用範囲外の使用を許諾する為、本規約をみなさまと締結することを目的としています。

１：「利用可能事項」
A : 営利目的、報酬目的等、金銭の受渡を目的とせず、本コンテンツを利用・使用し、二次創作物の創作、制作、公表を行うこと。
尚、当該利用・使用は、みなさまが本規約の内容に同意した時点で、本規約が相互に約（締結）されたこととし、わたしたちに対し許諾申請を必要とせず、当該利用・使用を行うことが出来るものとします。

B : みなさまがみなさま自身の発注により、みなさまのみの個人使用を目的とし、本コンテンツを用いた製造物又は成果物等を、第三者に委託し制作、作成等を行わせること。
但し、当該製造物又は成果物等にわたしたち以外の第三者の著作物等が含まれる場合の使用に関して、わたしたちは、一切の責任を負わないものとします。
尚、わたしたちは、みなさまが制作、作成を行わせる第三者に対し、当該第三者自身の宣伝、広告、販売促進等に使用すること、及び、みなさまより受託した製造物又は成果物等をみなさま以外の為に制作、作成、製造、販売する行為等は利用可能事項より除外することとします。

２：「個別許諾契約」
みなさまは、本コンテンツに関し、前記１のA及びＢ以外の使用に際し、わたしたちの事前使用許諾を必要とすることとします。
当該使用の許諾申請は、コチラよりご連絡下さい。
尚、全ての申請は、わたしたちよりみなさまへの使用の許諾を保証するものではなく、使用の目的や、申請の詳細等の内容如何により、許諾及び契約の締結を行うと行わないとの判断は、当該権利者としてのわたしたちのみが行うこととします。

３：「利用禁止事項」
「利用可能事項」に記載される事項以外の利用・使用の全てを禁止することとします。
尚、以下の利用・使用は厳重禁止事項とします。
・本コンテンツを「個別許諾契約」無しに、商用として利用・使用する行為（日本国の法令違反行為に該当する場合もあります。）
・本コンテンツのイメージを著しく損なう利用・使用又は、そのおそれのある行為の一切
・本コンテンツの著作者/著作権者の社会的な評価を損なう利用・使用又は、そのおそれのある行為の一切
・公序良俗に反する利用・使用又は、そのおそれのある行為の一切
・第三者の権利を侵害する、又は、そのおそれのある行為の一切
・わたしたち及び、本コンテンツに付随する関係各社（個人及び委員会、団体等を含みます。）のオフィシャル製品のような誤解を招くような利用・使用

重要：
• みなさまが、本コンテンツを利用・使用して作成された二次創作物の利用・使用を行う場合は、わたしたちのみならず、二次創作物の著作者/著作権者への申請、許諾を必要とするものとし、わたしたちは、当該二次創作物の利用・使用（わたしたちに帰属する著作物に於ける権利を除きます。）に起因する、いかなる損害についても、一切の責任を負わないものとします。
• みなさまは、本コンテンツの利用・使用に際し、本規約のほか、著作権法及び、その他関連する日本国の法令を遵守するものとします。
• 複製又は改変された本コンテンツに関する一切の権利は、わたしたちに帰属するものとします。
• この規約に記載されていない、本コンテンツに関する一切の権利は、わたしたちに留保されるものとします。
• わたしたちは必要に応じて本規約を改正することができるものとします。
尚、みなさまは随時、本規約が掲載されるウェブ・ページを閲覧及び確認することとし、最新の規約に記載された範囲内にて本コンテンツを利用/使用することとします。
尚、当該規約の改正に起因する、いかなる損害についても、わたしたちはみなさまに対し、一切の責任を負わないものとします。
・みなさまは、例外無く全ての利用・使用において、下記のクレジットを表記するものとします（○○○○○はタイトル）。

「○○○○○」はMILGRAM管理委員会の著作物です。
無断での当該コンテンツの転用・転載・配布等は禁止しております。

4：「キャラクター/ロゴ/イメージの使用」
みなさまは、キャラクター/ロゴ/イメージを使用することに関し、公式商品との差別化が難しいことを理解・了承し、最大限の注意をはらい取り扱うものとします。
尚、キャラクター/ロゴ/イメージを使用し、販売等を行わず発表（発表の方法・手段の如何を問いません。）する場合においても、クレジット表記や二次創作物であることの記載を行うものとします。
《立体創作物》
事前使用許諾を受けた場合のみ販売を許可するものとします。
《アクセサリー等》
非営利目的の範囲内であっても複製・頒布は禁止することとします。又、以下に記載される範囲を超えた製作は厳重禁止事項とします。
・みなさまが、個人で製作し、みなさま自身で着用（使用）するアクセサリー等
・みなさまが、個人的に製作し、少数（2〜3人程度）の友人・知人間のみで無償（無料）にて譲渡（プレゼント等）するアクセサリー等
尚、無償（無料）譲渡（プレゼント等）であっても、不特定多数・面識のない他者への配布は厳重禁止事項とします。
《ロゴ/イメージ》
いかなる場合においてもロゴ/イメージの使用は禁止することとします。
又、ロゴ/イメージ等の書体・画像（背景や配色等を含みます）等を変更し使用した場合においても、クレジット表記や二次創作物であることの記載を行うものとします。

5：「楽曲（音楽著作物の著作権）使用」
わたしたちが音楽著作物の著作権(作詞・作曲（歌詞やメロディ）の権利)を管理している音楽作品を利用される場合の手続き等については以下をご参照ください。

楽曲（音楽著作物）の著作権管理状況については下記よりご確認ください。
権利者（出版者）欄にOTOIROと記載されている楽曲がわたしたちの管理楽曲です。

Terms of Use

These Terms of Use clearly state the "Permitted Usage" and "Prohibited Usage" of the contents for which we have the rights (“Contents”), which we, as the rights holder, will use to conduct derivative works and other activities.

Purpose of this Agreement
The use or publication of these Contents without our permission is prohibited by the laws of Japan, but we are entering into this agreement with you for the purpose of granting you permission to use, utilize, and publish these Contents outside of the limited legal scope of use.

Section 1. Allowed Usage
A: To use Contents for the purpose of creating, producing, and publishing derivative works without the purpose of receiving money for profit or remuneration.
The use of Contents shall be deemed to be mutually agreed upon (concluded) when you agree to the terms of this agreement, and you may use the content without applying to us for permission.

B: You may, upon your own order, commission a third party to produce or create products or deliverables using Contents for your personal use only.
However, we shall assume no responsibility whatsoever for the use of any third party's copyrighted materials other than ours that are included in such productions or deliverables. We shall exclude from the scope of use by third parties for their own publicity, advertising, sales promotion, etc., and the creation, production, manufacture, and sale of products or deliverables entrusted to us by you, for the benefit of others.

Section 2. Individual Licensing Agreement
You are required to obtain our prior permission for any use of Contents other than those described in A and B in Section 1 above.

We, as the right holder, shall be the sole judge as to whether or not to grant a license or conclude a contract, depending on the purpose of use, the details of the application, etc.

Section 3. Prohibited Usage
All uses other than those listed in the "Allowed Usage" section are prohibited. The following uses are strictly prohibited.
・Any commercial use of the Content without an "Individual License Agreement" (which may constitute a violation of the laws and regulations of Japan).
・Any use or use that significantly damages the image of Contents, or any act that has the potential to do so.
・Any use or use that damages the reputation of the author/copyright holder of Contents, or any action that could potentially damage the reputation of the author/copyright holder of Contents.
・Any use or use that is or may be offensive to public order and morals
・Any act that infringes or may infringe on the rights of a third party
・Misleading use or use of Contents as if it were an official product of the company or the affiliated companies (including individuals, committees, organizations, etc.) associated with Contents

Important Notes:
・If you wish to use or exploit derivative works using or adapting Contents, you must apply for and obtain permission not only from us, but also from the authors/copyright holders of the derivative works, and we will not be liable for any use or exploitation of such derivative works (except for rights in copyrighted works that belong to us).
・In using Contents, you shall comply with the copyright law and other related laws and regulations of Japan in addition to these terms of use.
・We retain all rights to Contents as reproduced or modified.
・We reserve all rights with respect to Contents not expressly granted herein.
・We reserve the right to revise these terms and conditions as necessary.
　You shall read and check the web page where these terms are posted from time to time, and shall use Contents within the scope described in the latest terms of use.
　We shall not be liable to you for any damages whatsoever arising out of or in connection with any revision of these terms of use.
・You shall give the following credit for all use and exploitation without exception as shown below (XXXXX is the title).

Unauthorized diversion, reprinting, distribution, etc. of said content is prohibited.

Section 4: Usage of Characters, Logos, and Images

You must understand and acknowledge that it is difficult to differentiate the characters, logos and images from official products when using them, and you shall handle them with the utmost care.

In the event that a character, logo or image is used and not sold but publicized (regardless of the method or means of publicizing), the credit or the fact that the product is a derivative work must be indicated.

Three dimensional products Sales shall be permitted only upon obtaining prior permission for use.

Accessories
Reproduction or distribution of the materials, even for non-commercial purposes, is strictly prohibited. Any production beyond the scope described below is strictly prohibited.
・Accessories, etc. that you personally make and wear (use) by yourself
・Accessories, etc. that you personally make and give away (as gifts, etc.) free of charge to a small number of friends and acquaintances (approximately 2 to 3 persons).
Distribution to an unspecified number of people or to others who are not acquainted with you is strictly prohibited, even if it is free of charge or given as a gift, etc.).

Logos and Images
The use of the logos and images are prohibited under any circumstances.
In the event that the typeface, image (including background, color scheme, etc.), etc. of the logo or image, etc. is changed, a credit notation and a statement that the work is a derivative work must be included.

Section 5: Use of music (copyright of musical works)
Please refer to the following for the procedures for using musical works for which we manage the copyrights (rights to the lyrics and melody) of the musical works.
Please check the copyright management status of songs (musical works) below.
The music with "OTOIRO" in the "Rights Holder (Publisher)" column is the music we manage.
